The State has dropped its appeal against Graham Dwyer’s successful High Court challenge against Ireland’s law on mobile phone data retention.
Last month, the Court of Justice of the EU found that our laws in relation to the storage of this metadata is inconsistent with EU law.
The Supreme Court was expected to adopt the European ruling but now that the State has consented to the dismissal of its appeal, it will simply affirm the High Court's decision.
Once that’s done, Dwyer is expected to move ahead with his appeal against his conviction for the murder of Elaine O’Hara.
