The Supreme Court has ruled Tipperary Farmer Patrick Quirke's application for a re-trial has been dismissed.
He’s currently serving a life sentence for the murder of DJ Bobby Ryan.
The court heard that Patrick Quirke's conviction for the murder of Bobby Ryan still stands, and his application for a re-trial was unanimously dismissed.
Mr.Quirke is currently serving a life sentence for the murder of the DJ, also known as Mr.Moonlight.
In March, the court ruled a warrant to search Patrick Quirke's computer was unlawful.
However today, a seven judge panel dismissed the application for a retrial.
Mr Justice Peter Charlton told the court, leaving out reference to computers in a search warrant at the time was not deliberate and an ‘honest inadvertance’.
He said the Gardaí followed the law as it appeared at the time.
The application for a retrial submitted by Patrick Quirke’s lawyers was dismissed.
