EU Advice Recommends Revisiting Decision To Throw Out Apple Tax Case
An opinion to Europe's highest court has recommended a decision on the Apple tax case should be reviewed.
It relates to payments between 2003 and 2014.
Today's opinion is not legally binding - and recommends that the EU Commission's tax order on the tech giant should be referred back to a lower court for a new decision.
The Advocate General of the European Court of Justice found the General Court was mistaken in a decision to throw out the case.
The development is seen as a big setback in Ireland's defence of its tax treatment of Apple.
Multiple Irish Governments say the tax isn't owed - but the European Commission has argued the payment of taxes amounted to illegal State aid or a possible sweetheart deal.
